In the first 24-48 hours:

First, if your loved one is in the hospital, talk to the doctors. Ask for copies of all medical reports. If he or she is deceased, the hospital can help you with the necessary documents. Who Can File A Wrongful Death Claim In California

Not just anyone can sue when someone dies in an accident. California law is specific about who has the legal right.

They have Automatic Entitlement:

The wife or husband of the deceased is automatically entitled. It does not matter if they were married 50 years or 1 year. Marriage gives you this right.

Children also have an automatic right. It doesn’t matter if they are little or grown up. It doesn’t matter if they are biological or adopted. All children have the right.

Grandchildren can sue if their father or mother (the child of the deceased) has also died. This is called “right by representation”.

May Be Entitled With Proof:

If your loved one was not married but you were living together as a couple, you may be entitled. This is called a “putative spouse. You need to prove that you were in a serious relationship and lived together.

This is the question everyone asks me. And I understand why. It’s not that money will bring back your loved one. But money is the only thing the law can give you. Every Case Is Different:

I can’t give you an exact number without knowing your case. But I can tell you what factors increase the value:

The age of the deceased matters a lot. A 30-year-old who would have worked another 35 years is worth more financially than a 70-year-old who has retired. This does not mean that one life is worth more than another – all lives are precious. But the law calculates economic damages based on lost income.
